Customer Terms & Conditions

Version 2.0 · Effective September 27, 2026

This document is published in English only.

1. Who We Are and How You Accept These Terms

These Customer Terms & Conditions (Terms) govern pre-scheduled chauffeur transportation reservations arranged by CK Transportation Services LLC, an Arizona limited liability company operating under the DARKTIE brand (DARKTIE, we, us).

You accept these Terms:

  1. When you create an account — by checking the unchecked acceptance box presented at sign-up; and
  2. Each time you book — by acknowledging the booking disclosures shown on the confirmation screen before you authorize payment.

For telephone reservations, acceptance is obtained through a booking or payment link, or other documented affirmative acceptance, before any charge is imposed.

DARKTIE records the Terms version, the time of acceptance, the account or booking identifier, and the charge disclosures shown to you. The version you accepted when booking governs that booking.

You must be at least 18 years old and able to enter into a binding contract. If you do not agree to these Terms, do not book.

2. Prearranged Transportation Model

DARKTIE accepts advance reservations for luxury ground transportation and may arrange service through independent, properly authorized commercial transportation partners (Partners). The chauffeur and vehicle may be supplied by a Partner. DARKTIE does not offer on-demand street-hail service. Your confirmation identifies the pickup time, location, vehicle category, service fare and material booking conditions.

Reservations must be made at least one (1) hour before the requested pickup time and no more than thirty (30) days in advance.

3. Booking and Accuracy

You must provide accurate contact information, pickup address, pickup date and time, destination (or booked duration for hourly service), passenger and luggage counts, and any accessibility or child-seat needs. A booking is confirmed only after DARKTIE issues confirmation. Vehicle availability, legal seating capacity and safety requirements apply. Changes to an accepted booking require DARKTIE confirmation and may affect the price.

You may hold more than one reservation at different times. A new reservation cannot overlap the scheduled duration of an existing one.

4. Fares, Charges and Payment Authorization

4.1 What makes up the fare

The service fare for point-to-point service is calculated from the vehicle class, the route distance and estimated duration, and is subject to a minimum fare. The following charges may also apply and are always displayed on the confirmation screen before you authorize payment:

ChargeWhen it applies
Airport feePickup or drop-off at an airport
Meet & GreetOptional greeting service for airport pickups; amount depends on the style selected
Short-notice surcharge10% of the fare when the scheduled pickup is less than two (2) hours from the time of booking
Additional stopsAdded at booking, or during the ride under Section 6
Waiting timeSection 7
GratuityOptional, added by you after the ride (Section 4.4)

Current amounts are listed in Schedule A and may change; the amounts shown to you at checkout for a specific booking are the amounts that apply to that booking.

4.2 Hourly ("By the Hour") service

Hourly service reserves a chauffeur and vehicle for a booked number of hours, with a destination that may be left open.

  • Minimum booking: two (2) hours.
  • The hourly rate and the booked number of hours are shown at checkout.
  • A mileage allowance is included (see Schedule A). Miles driven beyond the allowance may be charged at the per-mile rate for the vehicle class, disclosed before it is charged.
  • Time used beyond the booked hours may be charged in the same manner as waiting time (Section 7), subject to chauffeur and vehicle availability.
  • Stops and route changes during hourly service do not change the hourly fare.

4.3 Payment authorization and holds

You authorize DARKTIE to charge the payment method you provide for the confirmed booking and for the charges described in these Terms and displayed to you.

When you confirm a booking, DARKTIE places an authorization hold on your payment method for the disclosed fare. A hold is not a completed charge. The amount is captured when the ride is completed. If a booking is cancelled without a fee, the hold is released; depending on your bank, a released hold may remain visible as pending for several business days.

If the total increases during the ride (for example, you add a stop under Section 6, or waiting time applies under Section 7), the difference is charged separately at that time, because an existing authorization cannot be increased. You will see the additional amount before it is charged where the change is made in the app.

DARKTIE uses a third-party payment processor. Card details are handled by the processor and are not stored by DARKTIE. Do not send card numbers by ordinary email or text message.

4.4 Gratuities

Gratuities are optional and are never added automatically. 100% of a gratuity belongs to the chauffeur who provided the ride. A gratuity may be added after the ride is completed, up to twenty-four (24) hours after completion, and is charged as a separate transaction.

5. Cancellation by You

When you cancelCharge
60 minutes or more before the scheduled pickupNo charge
Less than 60 minutes before the scheduled pickup50% of the base fare for the vehicle class
After the chauffeur is en route or has arrived at the pickup location100% of the base fare for the vehicle class
No-show (Section 8)100% of the full service fare

The base fare is the fixed component of the fare for the vehicle class, shown in Schedule A and disclosed at checkout. These amounts are charged to the payment method used for the booking.

No cancellation charge applies when the cancellation is attributable to DARKTIE or the Partner (Section 10), or where the chauffeur was not present and ready as agreed.

6. Additional Stops and Route Changes

Additional stops may be added when booking, or during the ride through the app. When you add or change a stop or destination during a ride:

  • the route is re-priced and the additional amount is shown to you before you confirm;
  • confirming the change authorizes the additional amount to be charged immediately;
  • for hourly service, route changes do not change the fare (Section 4.2).

A chauffeur may decline a change that is unlawful, unsafe, outside the service area, or that cannot be accommodated within the reserved time.

7. Waiting Time

The chauffeur waits at the designated pickup location for fifteen (15) minutes after the scheduled pickup time at no charge. After that period, waiting time is charged per minute at the rate shown in Schedule A and disclosed at checkout, until the passenger appears or the reservation is treated as a no-show under Section 8.

Waiting time during the ride at intermediate stops is charged in the same manner when it exceeds the time included in the booking.

If you expect to be late, contact DARKTIE immediately. Contacting DARKTIE does not extend the free waiting period unless DARKTIE confirms an extension.

8. Fifteen-Minute Passenger No-Show

If you have not appeared fifteen (15) minutes after the scheduled pickup time, the chauffeur may report a no-show through the DARKTIE Partner application. The reservation may then be cancelled after DARKTIE verifies the chauffeur's timely arrival at the correct location and reasonable attempts to contact you.

You authorize a charge of 100% of the disclosed reservation service fare for a verified no-show. This is the full service fare — not an additional 100% on top of an already paid fare.

A no-show charge does not apply where the chauffeur failed to appear, arrived at the wrong location, or otherwise caused the missed pickup. Contact DARKTIE promptly if you cannot locate the chauffeur.

9. Passenger Safety and Conduct

Passengers must comply with applicable laws, use seat belts, respect the vehicle's legal seating capacity, and follow reasonable safety instructions. Unlawful activity, threats, harassment, smoking or vaping, and damage to the vehicle are not permitted.

A chauffeur may decline or end service that is unsafe or unlawful. Any charge or refund in that situation is assessed according to the circumstances and applicable law — not automatically as a no-show.

Damage and cleaning. Where a passenger causes damage or soiling that requires repair or professional cleaning, DARKTIE may charge the documented, reasonable cost after providing you with the supporting documentation and an opportunity to respond.

Alcohol, smoking and controlled substances. Consumption of alcohol in the vehicle is permitted only where lawful and where the Partner allows it. Smoking, vaping and use of controlled substances are prohibited.

10. Luggage, Accessibility, Children and Animals

  • Disclose unusually large luggage, mobility aids and accessibility needs before booking so that appropriate service can be confirmed.
  • Child seats: passengers are responsible for compliance with child-restraint laws. If you request a child seat, it must be requested at booking and confirmed by DARKTIE.
  • Unaccompanied minors are not transported unless expressly agreed in writing in advance.
  • Service animals are welcome as required by applicable disability-access law. Other animals require advance approval and must travel in an appropriate carrier.
  • Passengers remain responsible for personal belongings. Report items left in a vehicle promptly; DARKTIE and the Partner will cooperate reasonably to locate property but cannot guarantee recovery. Reasonable return-delivery costs may apply and will be disclosed before they are incurred.

Nothing in these Terms limits rights under applicable disability-access laws.

11. Cancellations by DARKTIE and Refunds

If DARKTIE or its Partner cannot provide a confirmed booking, DARKTIE will make reasonable efforts to arrange acceptable replacement service. If no acceptable service is provided, DARKTIE will refund the amount charged for the unprovided service, subject to applicable law. You are not charged a cancellation or no-show fee for a cancellation attributable to DARKTIE or the Partner.

Refunds are issued to the original payment method where practicable; processing times depend on your payment provider.

12. Complaints and Payment Disputes

Contact DARKTIE promptly with your confirmation number and relevant details regarding a service issue, a no-show or cancellation charge, or a payment discrepancy. DARKTIE will review the available pickup, contact and transaction records and provide a response.

These Terms do not restrict non-waivable rights to dispute charges with a payment-card issuer or under consumer-protection law.

13. Your Account

You are responsible for the accuracy of your account information and for activity under your account.

You may delete your account at any time from Account → Delete Account in the application, or by contacting customer support. When you delete your account:

  • your profile is deactivated and you can no longer sign in;
  • the personal details on your profile (name, email address, phone number, profile photo, saved addresses) are anonymized;
  • your saved payment methods are removed from our payment processor;
  • booking, payment and safety records are retained for the periods required by tax, accounting, insurance and legal-defense obligations, as described in the Privacy Policy, and remain linked to the closed account for those purposes only.

An account cannot be deleted while you have an upcoming or active reservation; cancel it first (Section 5 applies to any cancellation charge). Deleting an account does not waive amounts already owed by either party.

To use DARKTIE again after deleting an account, create a new account.

DARKTIE may suspend or close an account for unlawful conduct, safety concerns, fraud or repeated payment failure, with notice where practicable.

14. Privacy and Communications

DARKTIE uses booking and contact information to arrange and support transportation and shares the minimum necessary details with the assigned Partner, the chauffeur, and the payment provider. The DARKTIE Privacy Policy describes what is collected, how it is used and retained, your rights, and how to contact us; it is available in the application and at darktie.app and forms part of these Terms.

By booking, you consent to transactional communications about your reservation (push notifications, email, SMS). Marketing messages are sent only with any consent required by law and can be turned off at any time.

15. Safety, Insurance and Incidents

15.1 Emergencies and collisions

Transportation may be performed by an independent, commercially insured Partner using its own chauffeur and vehicle. In an emergency or collision, prioritize your safety, call 911 when appropriate, and follow first-responder instructions. Notify DARKTIE as soon as reasonably practicable with your booking number and the factual details. DARKTIE may share necessary booking and incident information with the assigned Partner, insurers, emergency responders and authorities as permitted or required by law.

15.2 Insurance

Partners are required by their agreement with DARKTIE to maintain commercial automobile liability insurance and other coverage required for their vehicles and operations, and to keep current certificates on file with DARKTIE. Actual coverage depends on the applicable policy, endorsements, facts and law. DARKTIE may assist in identifying the assigned Partner and relaying claim information, but does not promise that a particular insurer will pay a claim or that policy limits will cover all losses.

Nothing in these Terms releases DARKTIE or a Partner from liability for its own negligence or other liability that cannot lawfully be excluded, restricts lawful claims against a responsible party, or limits rights protected by applicable consumer or transportation law.

15.3 Reporting a safety concern

Report an accident, injury, unsafe driving or serious service concern promptly through DARKTIE's published customer-support channel. Preserve relevant trip details, photographs and correspondence where safe and lawful. DARKTIE may investigate and may suspend a Partner or chauffeur while reviewing a serious safety concern.

16. Events Beyond Reasonable Control

Neither you nor DARKTIE is responsible for failure to perform caused by events beyond reasonable control, including severe weather, road closures, natural disaster, civil disturbance, strike, government action, or failure of public infrastructure or communications networks. Where such an event prevents service, Section 11 applies to charges and refunds.

17. Liability and Applicable Law

Each party retains responsibility for its own acts and omissions under applicable law. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

Arizona law governs these Terms, except where mandatory law provides otherwise. Before commencing litigation, please contact DARKTIE for a good-faith opportunity to resolve the concern; this does not limit statutory filing deadlines or non-waivable remedies.

18. Changes to These Terms, Electronic Records and Contact

DARKTIE may update these Terms prospectively. The version accepted at booking governs that booking unless you agree to a later version or law requires otherwise. Material changes are presented for acceptance before your next booking.

Electronic records and acceptances are valid as permitted by law.
